KEEPERS KPR — TERMS

Draft: these terms are being finalised before the pilot opens.

Terms of use

Keepers pilot · Last updated: [date]

Who we are

Keepers is a pilot operated by ITNas Ltd., a company registered in Bulgaria (EIK 208793733), with registered address at 6 Mihail Sarafov Street, Sukhata Reka, Poduyane District, 1505 Sofia, Bulgaria ("we", "us"). Contact: atanas@evalda.io. How we handle personal data is described in the privacy notice.

What the pilot is

A free test with a small group of DJs, run over about five weeks. If you are accepted, we email you track lists with links to buy the tracks on third-party stores, and ask you to tell us which ones you bought. Keepers (the name is a working name and may change) is not a store, a streaming service or a music licence.

Who can take part

You must be at least 18 and be a working DJ who meets the criteria on the application form. Places are limited. Applying does not guarantee a place, and we choose who takes part. We may remove someone from the pilot, for example for false answers or misuse.

What you agree to

The track lists

The lists are one person's selections. They are opinions, not advice or a promise that you will like, play or profit from any track. We choose tracks by listening, not by store commission, and no label or store pays to be on a list.

Stores and third parties

Links go to stores such as Beatport and Bandcamp. We are not affiliated with, endorsed by or acting for any store or rights holder, and we do not sell music. Anything you buy, you buy from that store under its own terms and prices. We never ask for your store logins and never buy on your behalf. Store names and marks belong to their owners.

Cost and the optional pre-sale

The pilot is free. Near the end we may offer an optional pre-sale for the future product. That will have its own terms, including price, refund conditions and your statutory rights, shown to you before you pay. Taking part in the pilot does not oblige you to buy anything.

Your content and our work

You keep all rights to what you send us. You allow us to use your answers and purchase reports to run and evaluate the pilot and to improve the product, as the privacy notice explains. The site, the lists, the brand and the software are ours or our licensors'. These terms give you no rights to them beyond using the lists as set out above.

Availability and changes

The pilot is experimental. We may change, pause or end it, or change the lists, at any time, and the site may sometimes be unavailable. If we change these terms in a way that affects you, we will email you before the change takes effect.

Liability

The pilot is provided free and "as is". To the extent the law allows, we are not liable for indirect or consequential loss, or for loss caused by third parties such as stores. Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury, for fraud, or for intentional wrongdoing, and nothing takes away your rights as a consumer where they apply. [Lawyer to confirm this section.]

Ending your participation

You can stop at any time by unsubscribing from the emails or telling us at atanas@evalda.io. Ask us to delete your data and we will, as described in the privacy notice.

Law and disputes

These terms are governed by Bulgarian law. [Lawyer to confirm the dispute and consumer-protection wording, including the EU online dispute resolution notice, if it applies.] If you are a consumer, you also keep the protections of the mandatory consumer law of the country where you live.
